General Terms and Conditions

Article I

Introductory Provisions

Legal relations arising between the service provider, in particular, but not exclusively, tourism guide services, the company Patrik the Guide s. r. o., with registered office at Turčianska 1161/34, 821 09 Bratislava – Ružinov, ID No.: 56 113 200, registered in the Commercial Register of the Municipal Court of Bratislava III, Section: Sro, Insert No.: 176886/B, acting through the managing director: Patrik Rentka (hereinafter referred to as “Provider”) and the Customer (hereinafter referred to as ‘Customer’) are governed by these General Terms and Conditions (hereinafter referred to as “GTC”) and the relevant legislation in force in the territory of the Slovak Republic and the European Union, respectively.

2. The Provider and the Customer may, in the order or in another written document signed by both parties, regulate their rights and obligations differently from the provisions of these GTC. In case of disagreement, the modification subsequently agreed shall apply.

Article II

Method of ordering services

The Provider’s services may be ordered by e-mail, telephone or written order.

2. The service order must include:

(a) identification of the Customer and the Customer’s e-mail and telephone contact,

b) billing information if the Customer requires an invoice,

c) identification of the service requested,

d) the time limit for delivery of the service.

3. The Customer’s order shall be binding for the Parties only after its e-mail or written acceptance by the Provider, whereby the Parties’ communication shall indicate an agreement on the determinability of the price of the service.

Article III

Cancellation fees

The Customer acknowledges that the Customer may cancel the Order at any time prior to the agreed date of delivery of the Services and the Provider shall not charge any cancellation fees, but if the Customer cancels the Order 24 hours before the date of delivery of the Service or part thereof, the Provider shall have the right to charge a cancellation fee equal to 100% of the price of the Service.

Article IV

Payment Terms

The Customer is obliged to pay for the Provider’s services in due and timely manner.

The price of the services provided by the Provider shall be payable in cash, immediately after delivery of the services by the Provider, into the hands of the Provider, on the basis of a tax document, unless otherwise agreed between the Customer and the Provider.

The price of the services provided by the Provider, in the case of non-cash payment, is payable within the due date indicated on the invoice issued by the Provider, which shall be deemed to be paid on the date on which the amount in question is credited to the Provider’s bank account.

The Customer acknowledges that if it fails to pay the price of the services or part thereof by the due date or within the period agreed by the Parties, the Provider shall have the right to demand interest on late payment at the rate of 0.05% of the amount due for each day of delay.

Article V

Delivery Terms

The Provider shall deliver the Service at the place and time agreed by the Parties.

In the event that the Provider is unable to provide the Customer with the ordered service within the agreed time, it is possible to change the date of delivery of the ordered service in agreement with the Customer. In the event that no agreement is reached on the change of the delivery date of the ordered service, the Customer shall have the right to withdraw from the contract and any payment made by the Customer to the Provider shall be refunded to the Customer.

Article VI

Other Arrangements

1. The Customer acknowledges that if the Customer is more than _____________ minutes late to the agreed meeting point, it is considered a cancellation of the order and the Provider has the right to charge a cancellation fee of 100% of the price of the service.

Customers are obliged to respect the Provider’s safety instructions during the provision of tour guide services. The Provider is not responsible for the life and health of the Customer and for the Customer’s belongings. The Customer acknowledges that during the contractual relationship with the Provider, the Customer acts at his/her own risk.

The Customer acknowledges that he/she is obliged to pay for any damage caused by his/her fault.

The Customer acknowledges that the use of audio recording devices is prohibited during the provision of services by the Provider. The Customer is not entitled to use, copy or reproduce any materials or documentation related to the Provider’s services.

Article VII

Service Complaints

The Customer shall be obliged to immediately complain about the service provided by the Provider directly at the place of service provision.

Article VIII

Termination of the contractual relationship

1. The Provider shall be entitled to withdraw from the contractual relationship if:

(a) circumstances have arisen on the part of the Customer which justify the Provider’s reasonable doubt as to the possibilities of timely and full performance of all obligations and commitments by the Customer,

b) if the Customer fails to comply with the terms and conditions set out in these GTC,

c) in other cases where this GTC, the Order or generally applicable law so permits.

Withdrawal from the contractual relationship does not affect the right to damages, contractual penalties and other sanctions.

Article IX

Final Provisions

These General Terms and Conditions are binding as of st of January 2025.

The Provider is entitled to change the content of the GTC at any time without prior notice, however, they are binding for the Customer only upon publication of the new version of the GTC on the Provider’s website https://patriktheguide.com/

The Customer acknowledges that the processing of the Customer’s personal data is governed by the Privacy Policy published on the Provider’s website referred to in point 2 above.
